Waiver Text

This document to be signed by all participants. If the participant is under 18 years of age, this document must be signed by parent or guardian.

Waiver: In consideration of being permitted to participate in the activities and programs of Boston Yoga Union and to use its equipment and facilities, I, for myself, my heirs, personal representatives and assigns, do hereby release, waive, covenant not to sue and discharge Boston Yoga Union and its representatives, employees, agents from any responsibility or liability from any and all claims including the negligence of Boston Yoga Union resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in the activities, programs, classes, offerings of Boston Yoga Union.

Assumption of Risks: I understand that participation in yoga, running, strength training, flexibility, core, and aerobic and cardiovascular exercise, including the use of equipment carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I know that fitness activities are potentially hazardous and certify that I am in good health and physically fit to enter into a training program. I acknowledge that I am aware of the many risks involved in athletic training which risks include by way of example and not limitation: 1) minor injuries such as scrapes, bruises, sprains and strains, 2) more serious injuries such as joint, muscle and bone injuries, concussions and other head injuries, heat related injuries such as heat stroke and heat exhaustion, dehydration and overhydration conditions such as hyponatremia, and catastrophic injuries and conditions such as heart attacks and other conditions or injuries which could be fatal. I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in athletic and fitness training. I hereby assert that my participation is voluntary and that I knowingly assume all such risks. I do hereby further declare myself to be physically sound and suffering from no impairment, condition, disease, infirmity or other illness that would prevent my participation or use of equipment except as hereinafter stated. I acknowledge that I have been informed of the need for for a physician’s approval for my participation in an exercise/fitness activity or in the use of exercise equipment. I agree to notify Boston Yoga Union regarding any physical condition that I may have which could be affected by my participation in any exercises. I do hereby assume all responsibility for my participation and activities, and utilization of equipment in my activities.

By signing this document, enrolling online, and/or attending in person Boston Yoga Union classes, events, activities, and other programs, to the extent allowed by applicable law, you voluntarily agree, on behalf of yourself, your heirs, personal representatives and/or assigns, and any minor child you may enroll: (a) to assume all of the foregoing risks related to COVID-19 and accept sole responsibility for any COVID-19 related injury, illness, damage, loss, claim, liability, or expense of any kind (including, but not limited to, personal injury, disability, and/or death) that may occur to you or your family members in connection with attendance at Boston Yoga Union or as a result of participation in Boston Yoga Union Services (“Claims”), and (b) covenant not to sue Boston Yoga Union, its instructors, clients, and employees for the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto based on the actions, omissions, or negligence of Boston Yoga Union, its instructors, its members, and its employees, whether a COVID-19 infection occurs before, during, or after entering Boston Yoga Union studio facilities or participating in any Boston Yoga Union Services.

Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD HARMLESS Boston Yoga Union from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in activities of Boston Yoga Union.

Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Massachusetts and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Marketing and Account Communication:  I agree to receive emails and/or SMS messages regarding account information and registration. Acknowledgment of Understanding: By electronically signing or otherwise electronically accepting and agreeing to this release you certify that you have carefully reviewed, fully understand and agree to the above.
